Maori Independence

The words “Tino Rangatiratanga” were used in both the 1835 Declaration of Maori Independence and the 1840 Treaty of Waitangi to denote absolute sovereignty - the power to make and enforce laws - in Aotearoa.

This right, in both documents, was reserved to the rangatira (Chiefs) of the hapu (subtribes) of nga iwi Maori.

Over 50 people packed the Cayuga courthouse on Wednesday for Trevor Miller, a Six Nations Mohawk of the Turtle Clan, as Trevor declared to the court that the colonial Canadian system has no jurisdiction over him. When the judge walked into the courtroom for the pre-trial hearing of Trevor Miller, and the bailiff called "all rise", only the cops and the lawyers stood up. When Trevor Miller walked in, however, the packed courthouse stood up, and they remained on their feet throughout the proceedings.

Complex consultation process may send research overseas
Valuable New Zealand research could head overseas if complicated consultation with Maori groups means research is delayed, the Waitangi Tribunal was told yesterday. Association of Crown Research Institute's executive director Anthony Scott, who addressed the tribunal hearing a claim by Maori to native flora and fauna, said industry could be hurt if scientists saw overseas as a better option for research.

A leader of the sub-tribe, Matarahurahu, says their ancestor, Hone Heke, was the first chief to sign the Treaty in 1840, which gives them the right to withdraw.

Some of New Zealand's biggest tribes are drawing up plans to take on the Government over control of the country's water.
The Weekend Herald understands that leaders of Tainui, Ngai Tahu, Tuwharetoa and Whanganui met on Thursday to develop a strategy to combat the exclusion of Maori from control of the country's fresh water.

Eight Arrested in Hapu's Bid for Far North Farm
Another attempt by a group of Far North Maori to establish physical ownership of a large sheep and cattle station near Mangonui was turned back by police yesterday. Eight members of Ngati Aukiwa hapu were arrested as they walked up a driveway to the entrance of the manager's residence of Stony Creek Station, 10km south of Mangonui.

Analysis of Waitangi Tribunal Report on WAI 262
On 3 October the Waitangi Tribunal released a further interim report on ANZTPA. It was an application for certain urgent interim recommendations. It did relate to the Crown proposal to introduce legislation to create a Trans-Tasman Therapeutic Products Authority in New Zealand (ANZTPA). The argument revolved around the proposal to regulate the practice of dispensing Maori medicine or rongoa Maori and that this was without adequate consultation. It is beyond the scope of this report to analyse that judgement and in the end it turned on very narrow criteria relating to the applicable principles to grant urgent recommendations.
